This Indenture made this third day of February in the year of our Lord one thousand eight hundred and forty four, between Martin H. Peck of the County of and State of of the one part, and Elijah N. Freeman of the and aforesaid of the other part, Witnesseth, that the said Martin H. Peck for and in consideration of the sum of three hundred dollars to him paid by the said Elijah N. Freeman, the receipt whereof is hereby acknowledged, hath granted, bargained and sold, and by these presents do grant, bargain, sell alien and confirm unto the said Elijah N. Freeman and to his heirs and assigns forever, all that tract or parcel of land situate and being in the County of in the State of , viz a part of Lot number Fifty-three in Block number four of Kimballs Addition to commencing at the North East corner of said Lot, thence South to the centre of Hotckiss Street, thence West to the centre of Warsaw Street, thence North to the North line of said Lot, thence East to the place of beginning, be the same more or less. To have and to hold the premises aforesaid, with all the privileges and appurtenances thereunto belonging, or in any wise appertaining, unto him the said Elijah N. Freeman and his heirs and assigns forever. Provided always, that these presents are upon this express condition, that if the said Martin H. Peck his heirs, executors or administrators, shall pay or cause to be paid to the said Elijah N. Freeman his heirs, executors, administrators, or assigns the sum of three hundred dollars in manner particularly specified in these certain notes or obligations bearing even date herewith and executed by the said Martin H. Peck to the said Elijah N Freeman as follows, to wit one note for one hundred dollars payable on or before the first day of April A. D. 1845. One note for one hundred dollars payable on or before the first [p. [1]] day of April A. D. 1846, and one note for one hundred dollars payable on or before the first day of April A. D. 1847 said notes paying drawing interest at the rate of six per cent per cent per annum from date, then and from thenceforth these presents and every thing herein contained, shall cease and be void, any thing herein contained to the contrary notwithstanding. I a Justice of the peace within and for said do certify that Martin H. Peck whose signature appears to the foregoing Mortgage and who is personally known to me to be the person described in and who executed the same, did acknowledge that he had executed the said conveyance for the use and purposes therein mentioned. Given under my hand and seal this nineteenth day of February in the year of our Lord one thousand eight hundred and forty–four
