Personally appeared before [3 words illegible] < Clerk of the Municipal Court> of <the> City of & & who being duly sworn according to Law deposeth and saith that the matter set forth in the warrant issued by by upon which they are held prisoners is false in that we have not assaul[t]ed or beat him at no time the complainant Josiah Simpson at no time and that the writ is informal and insufficent as wel cannot tell by the writ at what time the alleged assault and battery was committed and said affiants know not how to prepare for defence and that they are credibly informed that the complainat has said that he had the said & arrested only purpose for the purpose of cutting off there testimony in favor of the other prisoner and further deponents saith not and further the deponents saith that they know the said suit to be maliciously brought and further deponents saith not
