Bills to take testimony de bene esse were meant to take the testimony of witnesses “where the testimony may otherwise be lost” due to the age or infirmity of the witness. However, if the witness is neither aged or infirm, “an affidavit should be annexed to the bill” explaining why the evidence is in danger of being lost.
