Presumption

Summary

An inference of the existence of one fact from the existence of another fact. Some presumptions by law may be absolute and irrebuttable as, for example, a bond presumed to be conclusively executed for good consideration unless it is proven to be fraudulent. Other presumptions of law are rebuttable as, for example, the presumption of innocence. A presumption of fact for a jury is normally rebuttable. For example, the refusal by a person to deliver up goods on demand from the owner may infer an illegal conversion but is subject to rebuttal evidence.
