being duly sworn says that as he is informed and believes the record of this Cause still remains in the Circuit Court and that and John. D. Foster and others residents of are material witnesses for the that said witnesses reside in and that the claims and will take the depositions of said witnesses and others at Appanose in at the store of Tavern of Amos Perry in said town of Appanose on the 17th day of August 1844, between the hours of six in the morning and nine in the evening of said day.
