And for that whereas the said Joseph Smith deceasd in his lifetime on the twentieth day of March in the year of our Lord one thousand eight hundred and forty three for was indebted to the said for money found to be due to <from> the to the on an account then and there stated between them
Yet the said Joseph Smith in his lifetime and the said administrator as aforesaid after the death of the said Joseph Smith not regarding their said promises but contriving to <&c.> to deceive and defraud the said in this behalf have not nor hath either of them as yet paid the said several sums of money or any or either of them or any part thereof to the said (although often requested so to do).
