This cause came on to be heard upon a to the declaration of the pl[ainti]ff & was argued by counsel, on consideration thereof whereof, it is adjudge that the said demurrer be overruled with costs on motion of the def[endan]t leave is given him to amend— on payment of the costs— and this cause is continued until the next term— [p. 223]
