And now at this day came the Circuit Attorney who Prosecutes for the in this behalf (and there having been no Service of the Writ of herein upon the said defendants) and says that he will no farther Prosecute the said Indictments against the defendants herein. It is therefore considered by the Court here that the said defendants go hence thereof without day and that they Recover of the said State of their costs by them in this behalf Expended. [p. 150]
