And now at this day came the Circuit Attorney who Prosecutes for the in this behalf (and there having been no Service of the Writ of on the Defendants herein) and says that he will no farther Prosecute the Indictment against the said defendants: It is therefore considered by the Court here that the said Defendants and that they recover of the said State of their Costs by them in this behalf Expended. [p. 152]
