In Circuit Court April Term Eighteen hundred and Thirty nine
to wit
The Grand Jurors for the State of for the Body of the County of Aforesaid upon their oath Present that Joseph Smith Jr, , , Perry Durphee [Durfee], Ephraim Owens [Owen], John Lemmon, , , James Bingham, Amos Tubbs [Tubs], Absolem Snitchfield [Absalom Sentchfield], William Aldridge [Aldrich], , and , late of said on the first day of August in the year of our Lord Eighteen hundred and thirty Eight, with force and Arms at the County of Aforesaid did unlawfully, riotously and routously assemble and meet together to disturb the Peace of said and being so assembled and met together, the dwelling house of one there situate, then and unlawfully riotously <​&​> routously, did Break and Enter and in and upon the said , in the Peace of God and of our said , then and there being unlawfully riotously and routously, did make and Assault and him the said then and there unlawfully riotously routously did Beat, Bruise and ill treat him and then and there riotously routously and unlawfully did Threaten the life of the said in the Peace of God and our said then and there being as aforesaid so that the said [p.
