State of of the second part. Witnesseth: That the said party of the first part, for and in consideration of the sum of twenty eight hundred and thirty Dollars, in hand paid, the receipt Whereof is hereby acknowledged, do hereby grant, bargain, sell, convey, and confirm unto the said party of the Second part, his heirs and assigns forever, all and singular, the following described Lands situate, lying and being in the County of and State of and designated as the North half of Section Nine in township 6 north of Range Eight West of the fourth principal excepting eight acres previously sold to Darbin by Eri Rhodes decd. Also a part of the S. E. q[uarte]r of Sect. Eighteen in Township and range aforesaid and commencing at a Stone at the South West Corner of said qr. and running thence East twenty Rods, thence North forty rods, thence East twenty rods, thence South twenty rods, thence East twenty Six and two thirds Rods, thence North Sixty rods, thence East forty five and one third rods, thence North Eighty rods, to the North line of said qr. thence West one hundred and twelve rods, to the N. W. corner of said qr. thence South one hundred & Sixty rods to the place of beginning Containing Eighty two acres of land be the same more or less. Together with all and singular the hereditaments and appurtenances thereunto belonging or in any wise appertaining: To Have And To Hold the above described premises unto the said party of the second part his heirs and assigns forever, And the said party of the first part, the aforesaid premises unto the said party of the second part, his heirs and assigns, against the lawful claim or claims of all and every person claiming by through or under him doth and will Warrant and forever defend by these presents, Provided Always, That these presents are upon this express Condition, that if the said his heirs, executors, administrators, or assigns, shall on or before the twelfth day of July AD eighteen hundred and forty four pay or cause to be paid to the said Hugh Rhodes as administrator as aforesaid or his lawful attorney or Attorneys, heirs, executors, administrators, or assigns, the sum of Two thousand Eight hundred and thirty Dollars, together with the interest that may accrue thereon, at the rate of Six per cent, per Annum, from the twelfth day of July AD Eighteen hundred and forty four until paid, according to the tenor of two bonds or obligations, bearing date twelfth day of October AD. Eighteen hundred and forty three executed by the said to the said Hugh Rhodes as administrator as aforesaid that, then, and from thenceforth these Presents and every thing herein contained, shall cease and be null and void, any thing herein contained to the contrary notwithstanding: but otherwise to be in full force and virtue in law and equity: In Testimony Whereof, the said party of the first part, has hereunto set his hand and affixed his seal the day and year first herein written.
