This Indenture made and entered into this twelvth day of October in the year of our Lord One thousand eight hundred and forty three between Hugh Rhodes as Administrator of the estate of Erie Rhodes deceased party of the first part and of the County of and State of of the second part, Witnesseth, That whereas said Hugh Rhodes as Administrator as aforesaid, presented his petition to the Circuit Court in and for the County of and State of at the May term thereof praying a decree of the said Court for authority to sell so much of the real estate of which said Erie Rhodes died the owner as would be sufficient to pay the remaining debts against said Estate and whereas at said Term of said Court such proceedings were had on said petition that said Court made the following decree thereon to wit:

This day came the Complainant by his solicitor, and the defendant Orrin Rhodes being three times solemnly called came not, nor any person for him and it appearing to the satisfaction of the Court, that the petitioner has caused to be published a notice of this application to this Court for power to sell the real estate of said Erie Rhodes, decd. it is therefore ordered by the Court that petitioners petition and the matters and things therein contained be taken as confessed against said Orrin Rhodes, and thereupon came this cause on to be heard, upon the petition the answer of Alonzo Rhodes, Alvin Rhodes, Wallace Rhodes, and Bruce Rhodes, by their Guardian ad litum , and upon pro confesso orders as <to> defendant Orrin Rhodes, and the proofs in the cause and it appearing to the satisfaction of the Court that said Erie Rhodes died the owner of the following real Estate the S.E. qr of 18 & the NE qr of 8. both in township six North of Range 8 west of the 4th principal meridian, and that there is yet due for purchase money on the same the sum of $1200.00 with interest thereon from the 5th June 1840. The North half of Sect 9 in Township 6 North of Range eight west of the fourth principal meridian on which there is yet due for purchase [p. [83]]
