In accordance with the Nauvoo charter, when Whitney was elected an alderman for the Nauvoo City Council in February 1841, he was also commissioned as a justice of the peace for the city and for Hancock County. Illinois state law held that justices of the peace were to serve four-year terms, so it seems that Whitney remained a justice of the peace even though he no longer served as an alderman in the city council.
