July 31, 1837. The parties attended with out process, the produced a note, of which the following is a copy:
“$5.88. Sept. 19, 1836.”
“Due , or bearer, for value received, five dollars & eighty eight cents.” (signed) “Eli Woodworth.”
And the defendant claimed a set off of book account of $3.50, as per filled. An oath was administered to the defendant who testified to his account, and also to Wm. Tenny Jr. who testified that he knew defendant performed labor for . Whereupon the ballance was struck and judgment rendered against said Eli Woodworth, for the sum of one dollar and sixty eight cents debt, and $0.58 cents costs.
