Know all men by these presents that we as principal and Jesse Dass— & F I. Bartlet[t] & Isaac D MComsey as security are held & firmly bound unto James Campbell sheriff of in the State of in the sum of four hundred dollars lawful money of the , for the payment of which well & truly to be made we bind ourselves our heirs & assigns firmly by these presents— Signed sealed & dated this first day of July A. D 1843.— The Condition of the above obligation is such that whereas Joseph Smith has lately sued out of the Circuit Court of the County of a certain writ of in a certain plea of against the said & one returnable to the next term of the said court to be holden at on the second monday in September next— Now if the said shall be & appear at the said court to be holden at on said second monday next; and in case the said Jesse Dass & F. I. Bartlet, shall not be received as bail in the said action. shall put in good & sufficient bail, which shall be received by the plaintiff or shall be adjudged sufficient by the court— or the said Jesse Dass & F. I. Bartlet being accepted as bail, shall pay & satisfy the costs & condemnation money, or surrender himself in execution when by <​law​> such surrender is required [p. [1]]
