THE STATE OF , to the constable of township; in said county, greeting.
You are hereby commanded to summon Porter Yale and Stephen Yale that, all excuses and delays set aside, they be and appear before me Judge a justice of the peace within and for said township, on the [blank] day of forthwith 183[blank], at the hour of [blank] in the [blank] noon of that day, to testify the truth of their knowledge, touching a certain matter of controversy, before me him depending, between the State of plaintiff, and Joseph Smith & others defendant, on the part of the ; hereof fail not, and fail not at your peril, and have you then and there this writ.
