Know all men, by these Presents, That we, Joseph Smith Jr and Amos Davis [Jr.] & are held and firmly bound unto who sues for the use of Hungerford & Livingston in the sum of one hundred & seventy Dollars; for which payment, well and truly to be made, we bind ourselves, our heirs, executors, and administrators, firmly by these presents. Sealed with our seals, and dated this twenty first day of December in the year of our Lord one thousand eight hundred and forty
The Condition of this obligation is such, That if the above bounden & Joseph Smith Jr shall pay and satisfy whatever judgment may be rendered by the Circuit Court of the County of upon the dismissal or trial of a certain appeal to the said Circuit Court, this day taken by them from a judgment rendered by Esq. a Justice of the Peace within and for said , on the Fifth day of December in the year of our Lord one thousand eight hundred and forty wherein who sues for the use of Hungerford & Livingston is Plaintiffs and & Joseph Smith Jr Defendants, for the sum of Eighty five 81/100 Dollars debt, and three 11/100 Dollars costs of suit, in favor of the said Plaintiff and against the said Defendant then this obligation shall be void; otherwise, it shall remain in full force and virtue.
