KNOW ALL MEN BY THESE PRESENTS, That we Joseph Smith Jr & of the county of and State of are held and firmly bound unto Calvin C. Pendleton of the county of and State of his heirs and assigns in the sum of Two hundred and fifty dollars for the payment of which well and truly to be made we bind ourselves, our heirs, executors and administrators, firmly by these presents.
NOW THE CONDITION OF THE ABOVE OBLIGATION IS SUCH, that whereas, the said Joseph Smith Jr & have this day sold unto the said Calvin C. Pendleton a certain lot of ground situated, lying and being in the county of and State of , and described on the plat of the Town of as being . in Lot No One in Block No one hundred and thirty nine commencing at the South East corner of said Block running thence North seven rods thence West twelve rods, thence South seven rods thence East twelve rods to the place of beginning containing eighty four rods, more or less, and received in payment for said lot Two notes of hand bearing even date herewith for the sum of one hundred and Twenty five dollars and payable as follows. The first for twenty five dollars on demand The second for one hundred dollars on the first day of April A. D. 1841
with interest .
Now if the said Calvin C. Pendleton his heirs, executors, or administrators shall well and truly pay or cause to be paid, the amount of said notes with such interest as may accrue thereon, according to the tenor and effect thereof, when due, we the said Joseph Smith Jr & bind ourselves and heirs, executors and administrators, to make or cause to be made, a good and sufficient Deed for the above described lot to the said Calvin C Pendleton, his heirs or assigns and then this Bond to become null and void, otherwise to be and remain in full force and virtue.
Given under our hand and seal this first— day of August in the year of our Lord one thousand eight hundred and thirty nine
