You are herewith furnished with a copy of a note given by — — — Joseph Smith, & , for $4.866³⁸/₁₀₀, to Capt. Rob[er]t. E. Lee, of the Engineers, on account of property belonging to the upper , sold at auction on the 10thof last September, & which has been presented for no payment. The note is now in the Bank of Missouri. .— Capt. Lee has been directed to forward you his order on the Bank, for the same. It is apprehended that there will be delay in collecting it in , & you are therefore directed to put the same in suit <​as suggested in a letter from Capt. Lee a copy of which is herewith sent​> immediately by proofs from the Court in given District, for the purpose of arresting either of the Messrs. Smith, at , in Jully, when they often visit. This, it is <​believed​>, will speedily cause payment. Should the plan of arresting them fail, after waiting a reasonable time, you will advise me thereof, that I may give directions for a transfer of the note to this <​District​> Atty for for suit in that State.
