To each company there shall be one Captain, one First, one Second and one third lieutenant, four five Seargeants <one pioneer> four Corporals, one drummer <and 1 fifer> the said Seargeants Pioneers, & corporals, to be appointed by the Captains, respectively, and to hold their appointments by certificate
That each division <Cohort or> brigade, regement, battalion and company <of the same grade> when in the field shall take rank agreeably to the date of the commission of the officer commanding the or number of the Cohort or Brigade Regt Bat— or Company respectively as the case may be the lowest <number ranking> each division shall consist of [blank] brigades; each <Cohort or> brigade <shall consist of not less> of <than 2> regiments, each regiments of two Battalions each battalion of not less than two or more than four companies; each company shall consist of not less than thirty two or more than sixty four <rank & file> privates and no private shall be permitted to leave the company to which he belongs, without the permission of his Captain <unless in case of promotion> and no captain shall give such permission unless his company shall consist of more than 64 rank & file & each member over that number may claim a discharge from his Capt, by producing evidence that he has attached himself to another company.
<That> every officer, commissioned by virtue of this <act> shall within thirty days after recieving a commission, & previous to entering upon the duties of his office, take an oath to support the Constitution of the and of this , also an oath of office; an endorsment <or certificate> of which shall be on the back of his commission by the person administering the same: and if any person receiving such commission, who was elected by his own consent, shall fail to take the oaths as aforesaid, within the time herein [p. 5]
