State of Second Judicial Circuit

It is ordered by me that a special Term of the Circuit Court be held on the first Monday in July 1839 for the trial of and Morris Phelps who are now Confined in the Jail of the said for <​upon charge​> of murder and of who is also Confined in said Jail upon the charge of Robbery Given under my hand at the Circuit aforesaid this 7th day of June 1839

This day came the parties aforesaid by their attornies and the defendants moved the Court for a Continuance of this Cause and filed their affidavit which motion and reasons being Considered of by the Court, It is ordered that this Cause be Continued until the next regular Term of this Court, And on the motion of the defendants by their attorney It is ordered that a didimus issue to the State of and the Territory of to take the depositions of Witnesses to be read on the trial of this Cause” [p.
