I have understood, that Colonel , & against whom there is a writ for in Illinois, and are now in the state of , out of the reach of process, propose to surrender themselves to the authorities of this upon the following terms— <*> 1st <2d> In case there should be sufficient evidence in the mind of the to commit them or bind them over to court to answer for the said Crime, then the is to advise the prosecuting officer to agree that they may be bailed upon reasonable bail
<*> 1st That they shall be taken before for examination, and they shall be examined as soon as the witnesses of both parties can be obtained, or as Soon as a reasonable effort can be made to obtain them—
3 In case an indictment should be found against them the will advise the Prosecuting officer to agree to a continuance until the next succeeding term—
4th At the next succeeding term the will advise the Prosecuting officer if a proper affidavit in other respects shall be filed, not to resist a change of venue on account that the cause therefore was known to them at or after the previous term—
They shall be guarded by a detachment of the troops under the command of Genl until after the examination shall take place before the — All of which I agree to, & will do
