Whereas at the December Term <AD> 1851 of the Circuit Court of the for the District <and State> of a decree was rendered in a Suit in wherein the were Complainants and and heirs at Law of Joseph Smith deceased Lewis C Bidamon his wife Matthew McClaughry and others were defendants by which decree the Sum of $998.35 was found to be due from Joseph Smith deceased by Judgement to Said Complainants after deducting the the Amount hitherto made by Sales under a former decree rendered in this case and the real Estate herein after described with Other real estate adjudged to be liable for the payment of the Said Debt and ordered to be Sold for the payment of the Same
And Whereas by said decree was appointed a Special Commissioner to Sell and Convey Said real Estate under Said Decree first giving due notice of the time place and terms of Said Sale and of the property to be Sold and whereas as Such Commissioner, I gave due notice of Said Sale as required by Said Decree by advertisement of the time place and terms of Said Sale and of the property to be Sold, by publication in the Warsaw Signal a Weekly Newspaper printed in the County of aforesaid Said publication having been made on the 20th day of March and continued for four Successive Weeks Stating in said said publication that Said sale Would be held on the Third day of May AD 1852 at the Door of the Court house in in Adams County. And whereas I did on the Said 3 rd day of May AD 1852 at the Said place above named offer for Sale at public to the highest bidder for cash the following described real Estate and wife of Lewis C Bidamon of Illinois became the purchaser of the Same bidding therefor the Sum of Fifty dollars which Was the highest bid made for the Same
Now therefore Know All Men By These presents that I Special Commissioner as aforesaid acting under said Decree in consideration of the premises and of the Sum of Fifty dollars to me paid the receipt of which is hereby acknowledged have granted, bargained and Sold and <do> by These presents do grant bargain Sell convey and confirm unto the Said her heirs and assigns the following described premises Situate in the County of and State of aforesaid To Wit that part of the North ten Acres of the South West Quarter of Section Two (2) in Township Six north in Range nine (9) west Which lies west of the Town plat of in the County of And State of
To Have And To Hold together with <all> the appurtenances thereto belonging to her the Said her heirs and Assigns forever.
Provided however, that this Deed contains no implied Warranty on the part of Said . In Witness Whereof, I have hereto set my hand and seal this third day of May AD Eighteen hundred and fifty two
