Novr. 14th 1842. Upon the Oath of a Warrant issued against & , for the said wilfully & maliciously as believes, taking & conveying away Cotton Wood Logs belonging to him , nine or ten in number, in the City of , upon the said 14th. day of November 1842, and the said for aiding and abetting in the removal of said Logs as aforesaid, in said , County of , & aforesaid.
Novr. 15th. 1842. Warrant executed by <Constable> bringing the Defendants forward.
Novr 15th. 1842. A Subpoena issued upon behalf of the , for Isaac Riley Clark, , , Saml. P. Kelsy, Heltsy Wilford, & Thomas Kelsy, which was returned by , Const with the services marked on back thereof, upon said Witnesses, upon said day.
Same day the Witnesses Isaac R. Clark, , , Thomas Kelsy, & Saml. P. Kelsey, attended & were examined, as also the said , all on behalf of the .
, & George W. Davidson were produced, Sworn & examined as Witnesses for the Defendants.
The proofs and allegations being fully heard on the part of both Parties, it was adjudged that the Defendants <nor either of them> are not guilty, and that they be discharged, & to pay full Costs.
The Witnesses, , , Saml. P. Kelsy, & Thomas Kelsey, claimed payment for their attendances as Witnesses.
Decr. 10th. 1842. was made out for $6.00 Costs, as Taxed, and delivered to Const. on the 31st. Jany. 1843.—
March 1st. 1843. Execution returned, endorsed, “fees $0,50, no property found on which to levy, March 1st. 1843. . Con”.—
April 4th. 1843. Execution renewed, for $6.50 Costs, & delivered to Const. on the 26th April 1843.—
May 30th. 1843.— Execution returned, endorsed, “property sold to May 11th. 1843.— Recd Order by Order of the Mayor for $6.50 Given to this 30th day of May 1843.—
