judgment directed to the of said County of , commanding him that of the goods & chattels, and for want of goods & chattels of the lands and tenements of the said defendants, he should cause to be made the damages & costs aforesaid, and have the monies before said Court at their April Term then next to wit the third day of April AD 1838, which writ was delivered to 2d then being Sheriff of said , by virtue of which said proceeded as set forth in his official return thereto made to said Court at the term last aforesaid which return is in substance as follows to wit that he on the 29th day of March 1838 for want of goods & chattels levied said writ upon the following parcels of land lying & being in the Township of , Geauga County State of Ohio to wit, one lot known as part of lot No 23 and bounded as follows viz Beginning at the South East corner of Lot No 27, thence West on the line of land owned by Amos Wheeler to land owned by thence south on said s lands to land owned by Pierson; thence East on said Piersons land to land owned by S Gore; thence south 18 rods; thence east to the center of the old road; thence south on the centre of the old road to the place of beginning, containing thirty eight acres of land be the same more or less; Also one other piece in lot No 27 tract No 2 in said Township bounded as follows to wit Beginning at the South west corner of a lot of land bought of Oliver Higley which is in the centre of the old road on lot No 27 thence east 17 rods & twenty links to the centre of the new road; thence southerly 12 rods & five links; thence west parallel with the north line, twenty rods to the centre of the old road; thence north in the centre of the old road, ten & a half rods to the place of beginning containing one acre of land. Also an other lot in said bounded as follows; on the North East and south, by land owned by Seymour & Griffith; on the west by lands of Granger, McDaniels, Marchs, Bump, Boynton & Stratton; Also a certain lot bounded on the West by the highway, and on the south, east and north by lands owned by Samuel Canfield containing eight acres of land be the same more or less that at the same time he called there disinterested freeholders of, and resident in said viz , & who being duly sworn by said , and an actual view of said lands, did then and there appraise the same and seven hundred seventy three dollars & seventy cents & returned their said appraisal in writing under their hands and seals, a copy of which said forthwith deposited in the Office of the Clerk of said court & he returned said writ without further service for want of time to advertise. And whereas afterwards to wit on the 23d day of April AD 1838, a writ of issued out of said Court on said Judgment, directed to the of said commanding him to expose said lands to sale at public vendue & have the moneys before said Court at the June Term thereof AD 1838 which said writ was delivered to 2d then Sheriff of said and the predecesser in office of the present of said , which said of said to whom said writ was delivered returned the same into said Court at the June Term AD 1838 with his official report or return of his proceedings therein in substance as follows to wit. that in obedience thereto he caused a notice to be published in the Painesville Republican a weekly newspaper printed & in general circulation in said , that he should offer said lands for sale at public vendue, at the court house in in said on the fourth day of June AD 1838 between the hours of 10 Oclock AM & 4 Oclock PM which notice was published in said newspaper for more than thirty days next preceeding the said day of sale; that on the said fourth day of June, between the hours aforesaid at the Court House aforesaid he offered said lands for sale at public vendue, and then & there duly & legally struck off and sold all of said lands to on his bid of Five hundred & fifteen dollars & eighty cents that being the highest and only bid offered for said lands and more than two thirds the appraised value thereof; and the said 2d late Sheriff as aforesaid having failed to submit his said proceedings to said Court at said June Term 1838 & obtain an order for a deed, and his term of office having expired without having done so, and having been elected commisioned & qualified as Sheriff & the successor in office of said ; the said Plaintiffs at their April Term of said Court AD 1841 filed their motion in said Court to have said proceedings of said examined & app[r]oved by said Court, and an order made that said the [p. 193]
