Defendants
This day came Esqr who prosecutes for the people aforesaid in this behalf. the States Attorney William Elliott Esqr being absent and the said Defendants and William N. Grover as will in their proper persons as by and <​ & ​> their Attorneys and the said Defendants thereupon filed the Several affidavitts and moved the Court to quash the array of the Jurors Summoned herein for the first week of the present term on the account of the Supposed prejudice of the County Commissioners who Selected the Jury <​Said​> Jurors and the prejudice and partiality of the of the said County of and of his deputies who Summoned them including the Foreman who were Selected and Summoned since the Commencement of the present Term as mentioned and Set forth in the Said affidavitts which are filed as of record in this Court and are in the words and figures following to wit— (New inserit therin) And also moved the Court for the appointment of to act in the trial of this Cause for the reason that the said and Said Deputies are prejudiced against the Said Defendants and the of the Said is absent from the — Whereupon after hearing the arguments of Counsel on both sides upon said Motion and due Consideration being had thereon by the Court— It is orderd and adjudged that the said Motion be Sustained and that the said array of the Jurors Summoned hereon as aforesaid be quashed— And it is further Ordered that and be appointed as Elisors to serve as such in the Selecting and Summoning the Jurors in this Cause and for the further purpose of performing all such other duties herein as would be required by Law to be performed by the Said and his deputies during the progress of the trial in this Cause— [p.
