I know You— cant Say whether Smith was then dead or not— <I> supposed he had fainted— Smith said before that Oh Lord! While Smith hung in the window they were pretty still— after this <man> man set <Smith> him up <against the well curb> they shot him— the man did not hold him up until <while> they shot him— they <he> set him up against the well curb— on the South side of the curb— and they then shot him— The men who shot him Stood rather in a south easterly direction not directly facing him— four shot at him at the Same time— The man men stood at the fence who shot him probably 10 or 12 feet <from where Smith— was sitting—>— they all fired pretty much at the same time— dont know whether Smith’s eyes were open when they Shot him or not— did not See him give any signs of pain when they shot him—
