duly recorded in the Recorder’s Office of said Illinois on the 7th. day of June 1843 a copy of which said deed duly certified is hereto attached marked “B” and made a part of this answer, this respondant has not the possession or control of the original deed, but has made diligent search and inquiry for the same, and can get no trace thereof and believes the same to be lost or destroyed,
That said together with his wife on the 25th. day of April A. D. 1846 by their deed conveyed the same premises to the said Caleb J. Thomas for the consideration of six hundred and fifty dollars, which said deed is hereto attached and marked “C” and made a part of this answer whereby all title which the said Joseph Smith deceased was in his lifetime seized of became vested in this respondant,
That said Joseph Smith deceased did on 13th. day of September A.D. 1842 by his deed convey all his interest in said Lots No 2 and 3 in Block 127 in said to one together with other lots, for the consideration of four thousand and eight hundred dollars which said deed was duly recorded in said recorders on the 2nd. June 1846, which said deed is hereto attached marked “D” and made a part of this answer.
That said together with his on the 1st. day of June A. D. 1846 by his deed, conveyed, for the consideration of fourteen hundred dollars to one James E. Furness together with other property, said lot No. 3 in said Block 127, which deed was duly recorded in said Recorders Office on the 2nd. day of June A. D. 1846 a copy of which deed duly certified is hereto attached marked “E” and made a part of this answer,
That said James E. Furness on the 5th. day of July A. D. 1847 for the consideration of seven hundred dollars, conveyed said lot No 3 in said Block 127 to one William Quarter R. C. Bishop to wit:— the Roman Catholic Bishop of (Illinois),
Which said deed was duly recorded in the Recorder’s office of said County a copy of which said deed is hereto attached and marked “F” and made a part of this answer, and which said two last mentioned deeds the original thereof are not in the power of this respondant to produce, that he has made diligent enquiry for the same and believes the same to lost or destroyed.
That this Respondant on the second day of November A. D. 1849 purchased the same last described lot of the University of St. Mary of Lake, who were a corporation by the laws of this empowered to hold and convey land in whom the title of the said Furness through said William Quarter Bishop as aforesaid had become vested.
That respondant paid seven hundred dollars for said lot and obtained the deed of said corporation for the same, which said deed is hereto attached marked [p. 576]
